Market Watch: the EU pharmaceutical package reached second reading

Council adopted its first reading positions and Parliament referred the file to committee. Nothing is law yet, and the date that matters is 2028.

What changed. The Council adopted its first reading positions on both halves of the EU pharmaceutical reform, on 28 September 2026 for the Regulation and 1 October 2026 for the Directive. Parliament announced committee referral for second reading on 8 October.1 2

The file is now one Parliament vote from done. The indicative plenary sitting has moved from 11 November to 23 November 2026.1

Nothing is law yet. Nothing has been published in the Official Journal. Anyone reading that the package "is now law" is reading something wrong.

The date that matters is not November. The European Medicines Agency's own reform page records entry into force expected in 2026 and application in 2028, after a transition running from 2026 to 2028.3 So the practical question is not when the vote happens, it is whether your filing plan extends past 2028.

What the agreed text contains, per the political agreement of December 2025: eight years of regulatory data protection; one year of market protection, extendable by a further year for innovative medicines meeting two of three conditions; a transferable exclusivity voucher worth one additional year of market protection for priority antibiotics, unavailable to products with annual gross sales above 490 million euros over the preceding four years; and a Bolar exemption widened to cover submissions for procurement tenders.

Note the structure of the exclusivity provisions. The eight year baseline is only reached through conditions that have to be deliberately met. It is not what you get by default.

What to do now. If you have a product with an EU filing after roughly 2029, model both the current and the reformed exclusivity position, and identify which of the conditional extensions you could actually satisfy. That is a development and launch-geography question, not a regulatory affairs one, and it needs answering before the transition rather than during it.

If you are working on priority antibiotics, the voucher has a sales ceiling, so whether you qualify depends on your own revenue profile.

And watch 23 November. Not because the vote is in doubt, but because it starts the clock everything else hangs off.
